ChildLink Terms of Service
Terms for the ChildLink website, accounts and software service provided by yHere, Inc.
These Terms of Service (“Terms”) are an agreement between yHere, Inc., a Florida corporation (“yHere,” “we,” “us,” or “our”), and the person or organization that accesses or uses ChildLink (“you” or “Customer”). ChildLink is a yHere product. These Terms apply to myChildLink.com, ChildLink accounts and the ChildLink software service (collectively, the “Service”).
Separate yHere products, including HereNow and GovLink/SubsidyLink, are governed by their own terms and notices unless a written order form or agreement expressly states otherwise.
1. Acceptance and authority
By accessing or using the Service, you agree to these Terms. If you accept these Terms or purchase a subscription for a childcare center, school or other organization, you represent that you are an owner or other administrator authorized to bind that organization. Other invited users may use the Service only within the access and permissions granted by their Customer Organization and must comply with these Terms and applicable organization policies.
2. Accounts and access
You must provide accurate account information, protect your login credentials, use security features such as multi-factor authentication when required or made available, and promptly report suspected unauthorized access. Customer Organizations are responsible for inviting users, assigning appropriate roles and permissions, maintaining accurate access lists and removing access when it is no longer needed.
Where yHere shared identity features are enabled, a person may use a common yHere identity across participating services. A shared identity does not create shared authorization: access to each Customer Organization’s records remains controlled separately by that organization.
3. Customer responsibilities
Customer Organizations are responsible for:
- using the Service lawfully and only for authorized childcare and business purposes;
- providing required notices and obtaining required consent or authorization for child, family, staff, health, location, photo, payment and other information they enter or collect;
- configuring user roles, permissions, integrations and retention settings appropriately;
- maintaining accurate information and reviewing reports, exports and submissions before relying on them;
- ensuring users do not share credentials or bypass access controls; and
- maintaining any records the Customer Organization is legally required to retain, including after the Service ends.
4. Acceptable use
You may not use the Service to violate applicable law; access another organization’s information without authorization; harass, exploit or unlawfully monitor a person; upload malicious code; probe or circumvent security; interfere with the Service; reverse engineer the Service except where applicable law expressly permits it; misuse credentials; or use child, health, attendance, subsidy, payment or organization information for advertising or unrelated profiling.
5. ChildLink records and privacy
Customer Organizations retain their rights in the information and records they or their authorized users submit to ChildLink (“Customer Data”). Customer grants yHere the limited rights necessary to host, process, secure, transmit, back up and otherwise use Customer Data to provide and support the Service.
yHere retains rights in account, security and service information it collects for its own business and legal purposes, as described in the ChildLink Privacy Policy. The Privacy Policy also explains the distinction between a shared yHere identity, where enabled, and organization-specific records and permissions.
6. Payments and financial services
ChildLink may use Stripe to provide credit-card and ACH payment functionality and Plaid to provide authorized Customer Organization financial-account connections. Those providers may collect information directly and apply their own terms and privacy practices to their services. yHere does not intentionally store full payment-card numbers, bank-account credentials or online-banking passwords in the ChildLink application databases.
7. Subscription and billing
Unless an order form or other written agreement states otherwise, ChildLink is offered as a month-to-month subscription. Subscription fees, billing dates, selected plans, included locations or users, and any customer-specific commercial terms will be shown in the applicable order form, subscription record or checkout flow.
Monthly subscriptions continue until canceled. Unless a written order form states otherwise, cancellation takes effect at the end of the then-current paid billing period. Any credits, refunds or special billing arrangements will be governed by the applicable order form, subscription record or other written agreement.
8. Third-party services and integrations
The Service may rely on third-party providers or integrate with services selected by the Customer Organization. Third-party services are governed by their own terms and privacy practices. yHere may change infrastructure or service providers as reasonably needed to operate and secure ChildLink. Our current provider list is available on the Subprocessor List.
Optional integrations with separate yHere products, including HereNow and GovLink/SubsidyLink, do not give one Customer Organization access to another organization’s data merely because the same person or identity appears in both systems.
9. Ownership
yHere and its licensors retain all rights in the Service, software, technology, documentation, designs, trademarks and other yHere materials. Except for the limited right to use the Service during an active subscription, these Terms do not transfer ownership of yHere intellectual property to Customer.
Customer Organizations retain their rights in Customer Data. If you provide suggestions or feedback about ChildLink, you allow yHere to use that feedback to improve its products without an obligation to compensate you.
10. Confidentiality and security
Each party should protect confidential information received in connection with the Service using reasonable safeguards and use it only as needed for the relationship or as otherwise permitted by law. yHere maintains administrative, technical and physical safeguards designed to protect the information it processes. Customer Organizations are responsible for securely managing their own users, devices, credentials, exports and configuration choices.
11. Service changes, maintenance and support
ChildLink will evolve over time. We may add, modify or discontinue features, perform maintenance, apply security updates or change third-party dependencies. We will use reasonable efforts to avoid unnecessary disruption and to communicate material changes when appropriate. Support is provided according to the applicable subscription, order form or customer agreement.
12. Suspension
We may temporarily restrict or suspend access when reasonably necessary to protect users, Customer Data, the Service or third parties; respond to suspected fraud, abuse or security incidents; address nonpayment; comply with law; or prevent a material breach of these Terms. Where practicable, we will provide notice and an opportunity to address the issue.
13. Cancellation, export and deletion
A Customer Organization may cancel its month-to-month subscription as described in Section 7 or in its applicable order form. Before or shortly after termination, Customer should export records it needs to retain.
Organization data may remain recoverable for up to 90 days after termination to support export, recovery and orderly closure. After that period, yHere deletes the organization’s data from active production systems, subject to backups, legal holds, fraud and security records, and records yHere must retain for legal, tax or accounting purposes. Customer remains responsible for maintaining records it is legally required to keep. See our Data & Account Requests page for more information.
14. No professional advice
ChildLink is a software tool for authorized operational use. It does not provide legal, medical, tax, accounting, childcare licensing, government-benefit, employment or financial advice. Customer Organizations are responsible for reviewing information and decisions that require professional judgment or legal compliance.
15. Changes to these Terms
We may update these Terms as the Service changes. We will post the revised Terms and update the “Last updated” date. We will provide additional notice of material changes when required. If a separate signed agreement or order form states that it controls over these Terms for a specific subject, that written agreement controls for that subject.
